Article 1 – Purpose and Scope


These General Terms and Conditions of Sale (GTCS) govern all sales of plants and vegetation made by the company Greenforge to private or professional customers via its website. Any order implies unconditional acceptance of these GTCS.

Article 2 – Products


The plants offered for sale are described as accurately as possible. The photographs presented on the site are non-contractual and cannot engage the seller's liability. Since plants are living products, natural variations in shape, size, or color may exist compared to the visuals.

Each product is accompanied by a sheet detailing the recommended growing conditions (planting period, exposure, watering, type of soil, etc.). Adherence to these recommendations conditions the guarantee of return.

In the case of compositions or assortments, Greenforge reserves the right to replace a plant with an equivalent plant in terms of quality, characteristics, and value, particularly in the event of unavailability.

Article 3 – Price


Prices are indicated in euros, all taxes included (TTC). They do not include delivery charges, which are specified before order confirmation. Greenforge reserves the right to change its prices at any time, it being understood that products are billed based on the rates in effect at the time of order confirmation.

Article 4 – Order


The order is only definitively validated after confirmation of full payment. A confirmation email summarizing the order is sent to the customer. Order tracking is accessible from the online customer area. Greenforge reserves the right to refuse or cancel any order in the event of a prior dispute, suspicion of fraud, or unavailability of products.

Article 5 – Payment


Payment is made online by credit card or by any other means offered on the site. Payment is due immediately upon ordering.

Article 6 – Delivery


Greenforge delivers to mainland France, Belgium, Luxembourg, Germany, and the Netherlands.

Plants are shipped within an indicative timeframe specified at the time of order, subject to availability and weather conditions allowing for safe transport of the plants. Deliveries are made to the address provided by the customer. In case of absence, the customer is responsible for retrieving their package as soon as possible to preserve the vitality of the plants.

Greenforge reserves the right to change the initially scheduled delivery date if necessary, particularly for logistical, climatic reasons, or related to the availability of the plants.

Greenforge cannot be held responsible for delivery delays attributable to the carrier or resulting from events beyond its control.

Article 7 – Receipt and Claims


The customer must check the condition of the plants upon receipt. Any anomalies (damaged package, damaged plants, order error) must be reported within 48 hours of delivery by creating a ticket in the online customer area, accompanied by photographs. After this period, no claims regarding the condition upon delivery will be accepted.

Article 8 – Right of Withdrawal


In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to plants, which are goods that may deteriorate rapidly. No returns will be accepted except in cases of clear non-compliance of the delivered product.

Article 9 – Buyback Guarantee


Greenforge guarantees the buyback of the plants provided that the recommendations indicated on the product sheets are strictly followed, particularly regarding cultivation conditions, planting period, exposure, watering, and soil type.

In the event of a buyback failure, the customer has a period of 7 days from the planting of the plants to create a ticket in the online customer area. This report must be accompanied by the following elements:

• Photographs of the situation (concerned plant, planting environment)

• Geographic data of the planting location

• Description of the maintenance conditions applied

• Any other element allowing for the evaluation of compliance with the recommendations

After reviewing the file, Greenforge reserves the right to accept or refuse coverage under the warranty. In case of acceptance, a replacement of the plant or a credit note will be offered to the customer, excluding any other compensation.

The warranty does not cover damages resulting from exceptional weather conditions, negligence, non-compliance with cultivation recommendations, or any other factors external to the intrinsic quality of the plant.

Article 10 – Protection of Personal Data (GDPR)


Greenforge, as the data controller, collects and processes personal data in the context of order management, customer relations, and service improvement.

Collected Data.The collected data may include: first name, last name, postal address, email address, phone number, payment data, geographical data in the context of warranty claims, as well as any information voluntarily provided by the customer.

Purposes of Processing.The data is processed for: the execution of orders and their follow-up, the management of customer relations and after-sales service, the processing of requests under the return warranty, the sending of commercial communications (with prior consent), and compliance with legal and regulatory obligations.

Legal Basis.The processing is based on the execution of the sales contract, the customer's consent for commercial communications, and the legal obligations incumbent on Greenforge.

Retention Period.Order data is retained for the duration of the business relationship and for a period of 5 years from the last order for the purposes of managing warranties and legal obligations. Data collected for commercial prospecting purposes is retained for 3 years from the last contact.

Recipients.Data may be transmitted to service providers involved in the execution of orders (carriers, payment service providers) and to competent authorities in the event of a legal obligation. They are never transferred to third parties for commercial purposes without explicit consent.

Rights of individuals.In accordance with the General Data Protection Regulation (EU) 2016/679, the customer has the following rights:

• Right of access to their personal data

• Right to rectify inaccurate or incomplete data

• Right to erasure (right to be forgotten)

• Right to restrict processing

• Right to data portability

• Right to object to processing

• Right to withdraw consent at any time

• Right to lodge a complaint with the CNIL (National Commission on Informatics and Liberty)

These rights can be exercised via the online customer area or by mail to the registered office address. A response will be provided within one month of receiving the request.

Article 11 – Intellectual property


All elements of the site (texts, images, logos) are the exclusive property of Greenforge and are protected by intellectual property law. Any reproduction is prohibited without prior authorization.

Article 12 – Applicable law and disputes


These general terms and conditions are subject to French law. In case of a dispute, an amicable solution will be sought as a priority. Failing that, the competent courts will be those of the jurisdiction of the Commercial Court of Saverne.
